1. Who we are

This site, goreadyprep.com, is operated by CleverNRG LLC, a New York limited liability company ("we," "us," "our"). GoReadyPrep is a brand of CleverNRG. References to "GoReadyPrep" in these Terms mean CleverNRG LLC operating under that brand.

2. Acceptance

By using the site, placing an order, or signing up for our waitlist, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the site.

If you're using the site on behalf of a business or organization, you represent that you have authority to bind that entity.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. The site isn't directed at children under 13, and we don't knowingly collect data from them. See the Privacy Policy for details.

4. Orders, pricing, and product information

We display prices in US dollars. We try to keep product descriptions, specifications, and availability accurate, but we don't guarantee that everything on the site is free of errors. If we discover an error in a product's price or description after you've placed an order, we may cancel that order and refund the full amount you paid; we'll email you to explain.

Placing an order is an offer to purchase. We accept your offer when we charge your payment method and confirm the order by email. If we can't fulfill the order (out of stock, supplier issue, suspected fraud, shipping address we can't reach), we'll cancel and refund.

5. Payment

Payments are processed by Stripe. We do not store full payment card numbers; Stripe handles them under PCI-DSS Level 1.

Your card statement will read CLEVERNRG* GORDYPREP. CleverNRG LLC is the merchant of record.

6. Shipping

Shipping terms are described at /legal/shipping. Risk of loss passes to you when the carrier delivers the package to the shipping address you provided.

7. Returns and refunds

The return and refund policy is at /legal/refunds. It is part of these Terms.

8. Acceptable use

You agree not to:

use the site to violate any applicable law
attempt to interfere with the site's operation, including by transmitting malware, probing for vulnerabilities outside a coordinated disclosure, or scraping at a rate that degrades service for others
impersonate another person or misrepresent your identity at checkout
resell products acquired here without our written consent if you're acting as a competing reseller
use the site to harass any person, including our team

We may refuse service, cancel orders, or restrict access to anyone we reasonably believe is violating this section.

9. Intellectual property

The GoReadyPrep name, the GO·READY·PREP wordmark, the blueprint placeholder imagery, written content (gear guides, product descriptions, page copy), and the site's design and code are owned by CleverNRG LLC. You may not copy or republish them without permission. Linking to the site is fine.

Product photography may be supplied by manufacturer partners and remains their property; we use it under license.

10. Disclaimers

The site and the products are provided "as is" and "as available." We don't warrant that the site will be uninterrupted, error-free, or free of harmful components. We don't warrant that any product will meet your specific use case beyond what's described on its product page.

Survival and preparedness gear is not a substitute for training, judgment, or professional medical or legal advice. Use the gear at your own risk and within your own competence.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to your use of the site or any product you purchase is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if we've been advised of the possibility of such damages.

Some jurisdictions don't allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold CleverNRG LLC harmless from claims, damages, and expenses (including reasonable attorney fees) arising out of your violation of these Terms or your misuse of the site or products.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. The parties consent to the exclusive jurisdiction of the federal and state courts located in New York County, New York, for any matter not subject to arbitration under Section 14.

14. Dispute resolution and arbitration

Any dispute arising out of or related to these Terms or the products will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in New York County, New York, or by video at the consumer's request. Judgment on the award may be entered in any court of competent jurisdiction.

Opt-out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of your first order. Notice must include your full name, the email address used at checkout, and a statement that you opt out of arbitration. Opting out doesn't affect any other section of these Terms.

Small claims: Either party may bring an individual claim in small-claims court instead of arbitration if the claim qualifies under that court's rules.

15. Class action waiver

Disputes will be resolved on an individual basis only. Neither party may bring or participate in a class, collective, or representative action. If a court finds this waiver unenforceable as to a particular claim, that claim will be severed from arbitration and decided in court; the rest of these Terms remain in effect.

16. Termination

We may terminate or suspend your access to the site at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, Class Action Waiver, and this Section) will survive.

17. Changes to these Terms

We may update these Terms. Material changes will be flagged at the top of this page with a new "Last updated" date and (where required by law) emailed to confirmed waitlist subscribers. Continued use of the site after changes means you accept the updated Terms. If you don't accept them, stop using the site.
